Licenses for Purchase of Digital Images

All digital file sales are subject to a purchaser's agreement to the terms of the particular license applicable to the purchased product. The individual digital product descriptions expressly condition any sale on the purchaser's acceptance of those terms. By proceeding with a purchase, the purchaser is deemed to have read and agreed to the terms of the applicable licensing agreement.

Different licenses apply to different products. Be sure you read and understand the license applicable before you agree to purchase that product.

License 1. Royalty-free commercial use license (A royalty-free right to use the purchased item for any purpose, for profit or otherwise):

The owner ("Owner") of the copyrighted photograph or video being purchased (the "Work"), hereby grants you the non-exclusive, non-assignable, non-sublicensable, and perpetual right to use, reproduce, and distribute the copyrighted Work and to incorporate the copyrighted Work, in whole or in part, into derivative works for sale and distribution.

You are prohibited from using the Work for any other purpose, including: selling or distributing electronic copies of the Work as standalone files or as part of a product from which a person is able to extract the Work as a standalone file; distributing the Work in or as part of an electronic template (e.g., as an image available in a word processing or web page creation application) intended to be reproduced by third parties on electronic or printed products; or using the Work as part of a trademark, service mark or logo.

Owner retains all other rights in the Work and any derivative work, including without limitation, the right to use, copy, sell, license, and distribute copies of the Work in all markets and territories.

In consideration for the grant of this non-exclusive license, you agree to pay Owner the amount specified, due and payable immediately prior to your downloading a digital copy of the Work.

This Agreement shall be construed and enforced in accordance with the laws of Alaska, now or in the future.

License 2. Mid-Resolution unlimited personal (non-profit, non-commercial) use license (License limiting mid-resolution images to certain described uses, and prohibiting others. In essence, this license allows unlimited personal-only use online and to make 10 prints not exceeding 6x9. Don't let the legal language freak you out.):

The owner ("Owner") of the copyrighted photograph being purchased (the "Work"), hereby grants you the non-exclusive, non-assignable, non-sublicensable, and perpetual right to use, reproduce and distribute the copyrighted Work, in whole or in part, in online or electronic publications, including Web pages, and to print up to 10 copies of it in sizes not to exceed 6x9 without prior approval of the Owner. All such uses are exclusively for personal purposes, and not for profit or any commercial purposes.

You are prohibited from using the Work for any other purpose, including: using the Work in print media; selling or distributing electronic copies of the Work as standalone files; distributing the Work in or as part of an electronic template (e.g., as an image available in a word processing or Web page creation application) intended to be reproduced by third parties on electronic or printed products; using or displaying the Work on Web sites or in any other medium designed to induce or involving the sale, license or other distribution of “on demand” products, including postcards, mugs, t-shirts, calendars, posters and other similar items; or using the Work as part of a trademark, service mark or logo.

Owner retains all other rights in the Work and any derivative work, including without limitation, the right to use copy, sell, license, and distribute the Work in all markets and territories.

Owner has a continuing interest in maintaining the quality of his images after purchase and does not want that quality impaired without prior approval. Therefore, the largest print that may be made with this file is intentionally limited to no greater than nine inches long on its longest edge.

In consideration for the grant of this non-exclusive license, you agree to pay Owner the amount specified, due and payable immediately prior to your downloading a digital copy of the Work.

This Agreement shall be construed and enforced in accordance with the laws of Alaska, now or in the future.

License 3. High-resolution unlimited personal (non-profit, non-commercial) use license (License limiting high-resolution images to certain described uses, and prohibiting others. In essence, this license allows unlimited personal-only use online and to make 10 prints not exceeding 8x12. It also applies to 3-pack orders. Don't let the legal language freak you out.):

The owner ("Owner") of the copyrighted photograph being purchased (the "Work"), hereby grants you the non-exclusive, non-assignable, non-sublicensable, and perpetual right to use, reproduce and distribute the copyrighted Work, in whole or in part, in online or electronic publications, including Web pages, and to print up to 10 copies of it in sizes not to exceed 8x12 without prior approval of the Owner. All such uses are exclusively for personal purposes, and not for profit or any commercial purposes.

Owner retains all other rights in the Work and any derivative work, including without limitation, the right to use copy, sell, license, and distribute the Work in all markets and territories.

In consideration for the grant of this non-exclusive license, you agree to pay Owner the amount specified, due and payable immediately prior to your downloading a digital copy of the Work.

License 4. Low-resolution Personal Use License (License limiting low-resolution images to certain very limited uses, in view of economical pricing and availability of higher res files at higher price points. In essence, this license allows only smart-phone size screensavers and 2x3 inch prints. Don't let the legal language freak you out.):

The owner ("Owner") of the copyrighted photograph or video being purchased (the "Work"), hereby grants you the non-exclusive, non-assignable, non-sublicensable, and perpetual right to use, reproduce and distribute the copyrighted Work for personal non-profit purposes, and to incorporate the copyrighted Work, in whole or in part, into derivative works for non-profit distribution.

You are prohibited from using the Work for any other purpose, including: using, reproducing or distributing the Work and/or materials incorporating all or any part of the Work for profit; selling or distributing electronic copies of the Work as standalone files or as part of a product from which a person is able to extract the Work as a standalone file; distributing the Work in or as part of an electronic template (e.g., as an image available in a word processing or web page creation application) intended to be reproduced by third parties on electronic or printed products; or using the Work as part of a trademark, service mark or logo. You are also prohibited from processing the Work in any way that increases or enhances its resolution. This version of the Work is sold exclusively for use in its low-resolution state. Higher-resolution versions are available from the Owner and converting or attempting to convert the low-resolution image to a higher resolution image would violate this agreement.

In addition, Owner has a continuing interest in maintaining the quality of his images after purchase and does not want that quality impaired without prior approval. Therefore, the largest print that may be made with this file is intentionally limited to a small size, no longer than 3 inches long on its longest edge.

In consideration for the grant of this non-exclusive license, you agree to pay Owner the amount specified, due and payable immediately prior to your downloading a digital copy of the Work.

This Agreement shall be construed and enforced in accordance with the laws of Alaska, now or in the future.
